Terms of Service

These Terms of Service ("Terms") govern your access to and use of the MACCE GrowthIQ™ Auditor platform (the "Service") operated by MACCE Industries, LLC ("MACCE," "we," "us," or "our"). By creating an account or using the Service, you agree to be bound by these Terms.

1. Eligibility & Accounts

You must be at least 18 years old and authorized to act on behalf of the business you submit for analysis. You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account.

2. The Service

GrowthIQ™ generates business growth opportunity reports based on publicly available information about a website and its market. Reports include estimates, benchmarks, and recommendations that are provided for informational purposes only.

• Findings labeled Verified are derived from observable data.
• Findings labeled Estimated are model-based projections.
• Findings labeled Benchmark compare you to a peer set.

3. No Professional Advice

Reports are not legal, financial, tax, accounting, or investment advice. You should consult qualified professionals before making business decisions. Revenue opportunity ranges are illustrative and not a guarantee of results.

4. Acceptable Use

• You will not submit websites you do not own or are not authorized to analyze.
• You will not reverse engineer, scrape, or resell the Service.
• You will not use the Service to violate any law or third-party rights.

5. Intellectual Property

The Service, including the "MACCE GrowthIQ™" name, the MACCE Opportunity Score™, scoring methodology, report templates, and software, are owned by MACCE Industries, LLC and protected by intellectual property laws. You receive a limited, non-exclusive, non-transferable license to use reports generated for your own business purposes.

6. Fees & Subscriptions

Paid features are billed in advance and are non-refundable except where required by law. We may change pricing with at least 30 days' notice for existing paid plans.

7. Termination

We may suspend or terminate your access at any time for breach of these Terms or misuse of the Service. You may close your account at any time from your account settings.

8. Disclaimer of Warranties

The Service is provided "AS IS" and "AS AVAILABLE" without warranties of any kind, express or implied, including merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that reports will be error-free or that the Service will be uninterrupted.

9. Limitation of Liability

To the maximum extent permitted by law, MACCE Industries, LLC's total liability arising out of or relating to the Service shall not exceed the greater of (a) the amount you paid us in the 12 months preceding the claim or (b) USD $100. We are not liable for indirect, incidental, consequential, or punitive damages, or for lost profits or revenue.

10. Indemnification

You agree to indemnify and hold harmless MACCE Industries, LLC from any claims arising out of your use of the Service or your violation of these Terms.

11. Governing Law

These Terms are governed by the laws of the State of Texas, USA, without regard to conflict-of-laws principles. Any dispute shall be resolved exclusively in the state or federal courts located in Travis County, Texas.

12. Changes

We may update these Terms from time to time. Material changes will be notified by email or in-app notice. Continued use after the effective date constitutes acceptance.
